These Terms of Service ("Terms") govern your access to and use of the Handful of Angels platform, including the website at handfulofangels.com, the Handful of Angels mobile application, and all related services (collectively, the "Platform"). The Platform is operated by Handful of Angels, Inc. ("HOA," "we," "us," or "our"). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Handful of Angels is a community-support platform designed to rally encouragement, connection, and optional financial support around individuals facing a cancer diagnosis ("Survivors"). The Platform enables users ("Angels") to create campaigns on behalf of Survivors, invite supporters, share posts and well-wishes, and optionally raise funds through donations.
Handful of Angels is not a charity, nonprofit organization, or licensed financial advisor. We are a for-profit technology platform that facilitates peer-to-peer fundraising and community support. We do not guarantee that any campaign will reach its fundraising goal. Donations made through the Platform are gifts between individuals and are generally not tax-deductible.
Handful of Angels acts as a technology intermediary — we provide the tools for campaign creation, community engagement, and payment facilitation. We do not take custody of donated funds; all payments are processed and held by our third-party payment provider, Moov Financial, Inc., until disbursed to the designated Beneficiary.
You must be at least 18 years of age to create an account and use the Platform. By registering, you represent and warrant that you are 18 or older. If we learn that a user is under 18, we will terminate their account.
A campaign may be created on behalf of a minor (under 18) who has a cancer diagnosis. In such cases, the campaign must be managed by a parent, legal guardian, or other adult (18+) who assumes full responsibility for the campaign and any funds raised.
The Platform is currently available to users in the United States. Payment processing, identity verification, and fund disbursement are limited to U.S. bank accounts and payment methods.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
The Platform recognizes the following roles. A single user may hold multiple roles across different campaigns:
Angels create campaigns by providing information about the Survivor, including the Survivor's name, cancer type, and a description of the campaign's purpose. Angels represent and warrant that:
We reserve the right to review, approve, pause, or remove any campaign at our sole discretion. Campaigns may be placed in a pending review state before becoming publicly visible. Campaigns may exist in various states including draft, active, paused, completed, canceled, or memorial.
When a Survivor passes away, a campaign may be converted to memorial status. Memorial campaigns may continue to accept legacy donations, display memories, and serve as a lasting tribute. Memorial campaigns are subject to additional review before activation.
If we determine, in our sole discretion, that a campaign contains materially false or misleading information, or that funds are being misused, we may suspend or terminate the campaign, withhold or reverse fund disbursements, report the matter to law enforcement, and permanently ban the responsible users.
All payments are processed through our third-party payment processor, Moov Financial, Inc. ("Moov"). By making a donation, you agree to Moov's terms of service in addition to these Terms. We do not store your credit card or debit card information on our servers. Card data is tokenized and handled directly by Moov.

The Platform allows Supporters to send gift cards for meal delivery services (such as DoorDash, Uber Eats, Grubhub, and Instacart) to Survivors. By purchasing a gift card through the Platform:
Campaign funds are held in a payment-processor-managed wallet associated with each campaign. Before funds can be withdrawn, the designated Beneficiary must complete identity verification ("Know Your Customer" or KYC) through our payment processor, which may include providing:
We reserve the right to delay or withhold disbursement if we suspect fraud, a dispute is pending, or as required by law. If funds remain unclaimed after a campaign ends, we will handle them in accordance with applicable state unclaimed-property laws.
You retain ownership of content you post on the Platform, including text, photos, videos, voice recordings, and other media ("User Content"). By posting User Content, you grant HOA a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and promoting the Platform.
You agree that your User Content will not:

Certain features of the Platform may use artificial intelligence to enhance user-generated content, such as improving photo captions for memorial campaigns. When AI tools are used, they process only the specific content being enhanced. You retain full ownership and control of your content, and AI-generated suggestions can be reviewed and modified before publishing.
The Platform, including its design, logos, graphics, software, text, and all other materials (excluding User Content), is owned by or licensed to HOA and is protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.
"Handful of Angels," the Handful of Angels logo, and related marks are trademarks of Handful of Angels, Inc. If you provide suggestions, ideas, or feedback about the Platform, you grant us the right to use such feedback without restriction or compensation to you.
You agree not to:
You are responsible for maintaining the security of your account, including your password and any authentication methods (MFA codes, trusted devices, biometric credentials). You must notify us immediately at security@handfulofangels.com if you suspect unauthorized access to your account.
We may require multi-factor authentication for certain actions, particularly those involving financial transactions or administrative access. For your protection, sessions automatically expire after a period of inactivity.
The Platform integrates with third-party services to provide its functionality. By using the Platform, you acknowledge that your use of these third-party services is subject to their respective terms:
We are not responsible for the practices or policies of these third-party services.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, HOA disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No Medical Advice: The Platform is a community-support tool. Nothing on the Platform constitutes medical advice, diagnosis, or treatment. References to cancer types, diagnoses, or treatments in campaign descriptions are provided by users, not by HOA. Always seek the advice of qualified healthcare providers for medical decisions.
No Financial or Legal Advice: HOA does not provide financial, tax, or legal advice. Information about fees, donation tax treatment, or fund disbursement is for general informational purposes only.
To the maximum extent permitted by applicable law, HOA, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Platform.
HOA's total aggregate liability for all claims arising out of or related to these Terms or the Platform shall not exceed the greater of (a) the amount you paid to HOA in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
HOA is not liable for the actions, omissions, or conduct of any user, including but not limited to misuse of campaign funds, fraudulent campaigns, or harmful User Content.
You agree to indemnify, defend, and hold harmless HOA and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Platform; your User Content; your violation of these Terms or any applicable law; your violation of any third party's rights; any campaign you create or manage, including the use or misuse of funds raised; and any dispute between you and another user of the Platform.
Informal Resolution: Before filing any formal legal proceeding, you agree to first contact us at legal@handfulofangels.com and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
Class Action Waiver: You and HOA agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Governing Law: These Terms are governed by and construed in accordance with the laws of the United States and the State in which Handful of Angels, Inc. is incorporated, without regard to conflict-of-law principles. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Platform with a new effective date and sending a notification to the email address associated with your account. Your continued use of the Platform after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Platform.
You may close your account at any time by contacting us at support@handfulofangels.com. Closing your account does not relieve you of any obligations incurred before closure, including responsibility for campaigns you created or funds you received.
We may suspend or terminate your account at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if continued access poses a risk to the Platform or other users. Upon termination, your right to use the Platform ceases immediately. We may retain your data as required by law or as necessary for legitimate business purposes. Sections 8 (User Content), 10 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), 16 (Indemnification), and 17 (Dispute Resolution) shall survive any termination of these Terms.
